Montgomery County Record — Cause No. 23-07-10483

Montgomery County

Cause No. 23-07-10483

A dispute that began with an HOA lawsuit, later shifted after the HOA nonsuited its own claims, and continued through Eric Springstun’s counterclaims and appeal.

The public appellate record shows that The Wharf at Clear Lake Slip Maintenance Association initiated the Montgomery County case in July 2023. Eric Springstun denied the Association’s allegations and asserted claims of his own.

Important context

The Association’s temporary-injunction request was denied.

The appellate opinion records that the Association obtained an initial temporary restraining order. After the temporary-injunction hearing on August 31, 2023, however, the trial court denied the Association’s request for a temporary injunction.

That point matters because a search-result summary that begins and ends with the existence of litigation can miss the fact that the Association did not obtain the requested temporary injunction after the hearing.

Association filed first

The Association initiated the suit in July 2023. Springstun responded, denied the allegations, and asserted counterclaims.

Association later nonsuited

On February 23, 2024, the Association filed a notice of nonsuit without prejudice, and the trial court granted the nonsuit of the Association’s claims.

Counterclaims continued

The later summary-judgment proceeding and appeal concerned Springstun’s counterclaims, not a merits judgment granting the Association the injunctive relief it originally sought.
Later procedural history

The counterclaims were resolved against Springstun and the judgment was affirmed.

On May 24, 2024, the trial court granted the Association’s traditional and no-evidence motion for summary judgment on Springstun’s live counterclaims. The Ninth Court of Appeals later affirmed that judgment in No. 09-24-00270-CV on August 28, 2025.

This site does not hide that result. It places it in sequence: the Association first sued Springstun, its temporary-injunction request was denied, the Association later nonsuited its own claims, and the remaining dispute over Springstun’s counterclaims proceeded to summary judgment and appeal.

The fuller record contains both adverse rulings and procedural events that are easy to lose when a case is reduced to a headline.
